Traffic Court produces a long line of defendants and their cash.  

 

Anything that slows this process down is avoided by the Court.
Trials can actually COST the State to prosecute, even if the Defendant is convicted!

 


 

 

Plea deals are a way of saving time and money. 
But all plea bargains are not created equal.
 

 

 

UNSAFE DRIVING 39:97-2 is generally the first plea deal offered for Speeding Tickets on the day of Arraignment.  


UNSAFE DRIVING is a horrible bargain.


Even for a first offense, this "deal" comes with a hefty fine up to $150, Court costs up to $33, a $250 surcharge, and a possibly increased insurance premium... all in exchange for a 0 point ticket.

 

 


 

 

Two great deals that I and other Defendants have pleaded Guilty to: 

 

39:3-44 Vehicle in Unsafe Condition

39:4-67 Obstructing Passage of Vehicles

  

Both are 0 point tickets with reasonable fines and no surcharges.

 

 But these plea bargains were not an option until I rejected the Prosecutor's first offer.   

 

 


  

 

It's worth noting that pleading guilty to any charge may still affect insurance rates
and will certainly be marked on a driving record.

 

That's why I prefer to see what turns up in Discovery before accepting ANY plea deal!
